Terms of Service

These Terms of Service govern your use of GPSR Desk, operated by Bjorvand Solutions.

By using the website, purchasing an audit, submitting an intake form, or using any report, checklist, template, or generated text, you agree to these Terms.

1. What GPSR Desk provides

GPSR Desk provides listing audit, documentation organization, checklist, and marketplace text preparation services for sellers who sell physical products to the EU, EEA, or Northern Ireland.

Services may include:

• GPSR listing readiness audits
• Missing information checklists
• Product documentation checklists
• Etsy or Shopify listing text drafts
• PDF reports
• CSV or copy-paste exports
• General guidance on organizing product safety information

2. No legal advice or compliance certification

GPSR Desk does not provide legal advice.

GPSR Desk does not certify that your products, listings, labels, documentation, business, store, or sales process comply with GPSR or any other law.

GPSR Desk does not replace:

• a lawyer
• a compliance consultant
• a product safety expert
• an EU Responsible Person
• a market surveillance authority
• a product testing laboratory
• your own legal or regulatory review

Any reports, checklists, snippets, or outputs are for informational and organizational purposes only.

You are fully responsible for reviewing all outputs before using them.

3. No Responsible Person service

GPSR Desk is not an EU Responsible Person, authorized representative, importer, manufacturer, distributor, fulfilment service provider, or legal representative for your products.

If your product requires an EU Responsible Person or other economic operator, you are responsible for appointing one.

4. Customer responsibility

You are responsible for:

• providing accurate, complete, and up-to-date information
• confirming whether GPSR or other rules apply to your products
• confirming whether you need an EU Responsible Person
• checking product labels, packaging, instructions, warnings, and translations
• ensuring your products are safe and lawful to sell
• keeping your own product safety documentation
• reviewing all generated text before publishing it
• getting professional advice where needed

You must not rely on GPSR Desk as your only compliance step.

5. Product categories and high-risk products

GPSR Desk may refuse, limit, or manually review requests involving higher-risk products, including but not limited to:

• toys
• baby or children's products
• cosmetics
• electronics
• medical products
• food or feed
• supplements
• candles or products with fire risk
• chemicals
• batteries
• CE-regulated products

We may decline a request if we believe the product category is too legally or technically risky for the service.

6. Payments

Payments are processed through Stripe or another third-party payment provider.

You agree to pay the listed price at checkout, including any applicable taxes.

Stripe may process payment and transaction data according to its own privacy and legal terms. Stripe states that it receives transaction data when users pay through its services.

7. Refunds

Because audits and reports are custom services, refunds are generally not available once work has started or a report has been delivered.

You may request a refund before work has started by contacting us.

This does not limit any mandatory legal rights you may have under applicable law.

8. Delivery

Delivery timelines shown on the website are estimates unless explicitly stated otherwise.

If we need more information from you, delivery time may depend on how quickly you provide it.

9. Use of outputs

You may use the final report, snippets, checklists, and exports for your own business.

You may not resell, redistribute, copy, or publish GPSR Desk templates, report formats, internal systems, prompts, or proprietary materials as your own competing product or service.

10. AI-assisted outputs

Some outputs may be generated or assisted by AI.

AI outputs may contain mistakes, omissions, unclear wording, or unsuitable suggestions.

You must review all outputs manually before using them.

GPSR Desk does not guarantee that AI-generated content is accurate, complete, legally sufficient, or suitable for your product.

11. Your submitted content

You keep ownership of the information, files, product details, documents, images, and materials you submit.

You give us permission to use submitted content only as needed to provide the service, generate reports, improve your requested outputs, provide support, and maintain business records.

You confirm that you have the right to submit any third-party information, including manufacturer details, Responsible Person details, supplier documents, invoices, images, and product data.

12. Confidentiality

We will not intentionally disclose your non-public business information except where needed to provide the service, use service providers, comply with law, prevent fraud, protect our rights, or with your permission.

13. Third-party services

GPSR Desk may rely on third-party services for payments, hosting, email, analytics, file storage, forms, AI processing, and support.

We are not responsible for third-party service outages, errors, policies, or security incidents outside our reasonable control.

14. No guarantees

We do not guarantee:

• that your listings are compliant
• that your products are legally safe
• that Etsy, Shopify, Amazon, eBay, TikTok Shop, authorities, or marketplaces will accept your listings
• that you will avoid fines, suspensions, removals, complaints, or legal action
• that all missing information will be identified
• that GPSR or other legal requirements will not change

15. Limitation of liability

To the maximum extent permitted by law, GPSR Desk and Bjorvand Solutions are not liable for indirect, incidental, consequential, special, punitive, or business losses, including lost profits, lost revenue, marketplace suspension, product removal, fines, legal costs, or compliance failures.

To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid for the specific service that caused the claim.

Nothing in these Terms limits liability that cannot legally be limited.

16. Indemnity

You agree to defend and hold harmless Bjorvand Solutions from claims, losses, damages, liabilities, costs, and expenses arising from:

• your products
• your listings
• your use of our outputs
• inaccurate information you provide
• your breach of these Terms
• your violation of laws or marketplace rules
• third-party claims related to your business

17. Changes to the service

We may change, suspend, or discontinue parts of the service at any time.

18. Governing law

These Terms are governed by the laws of Norway, unless mandatory law gives you rights in another jurisdiction that cannot be waived.
